Sim Club - Elite Golf Indoors

Privacy Policy

Effective Date: July 15, 2025

Sim Club (“Sim Club,” “we,” “us,” or “our”) respects your privacy and is committed to protecting your personal information. This Privacy Policy explains what information we collect through our website (including our pre-launch landing page) and how we use, share, and protect that information. It also outlines your rights regarding your data. By using our site or providing us with your information, you agree to the practices described in this Privacy Policy.

Information We Collect

Information You Provide Voluntarily: The only personal information we collect directly from you is the email address you provide when signing up for our newsletter or updates. Submitting your email is voluntary, and you may choose not to provide it; however, without it we cannot send you our newsletter or pre-launch announcements. Aside from the newsletter signup, our site does not ask for or collect other personally identifiable information. If you contact us directly (for example, by emailing us), we will receive any information you choose to send (such as your name or message details) and will use it only to respond to your inquiry.

Information Collected Automatically: When you visit our site, we automatically collect certain technical and usage data via Google Analytics. This includes basic website usage information such as your IP address, browser type, device type, pages visited on our site (and the time spent on those pages), and the website or search query that referred you to our site. We collect this data to understand how visitors interact with our website so we can improve the user experience and site performance. This information is collected in an aggregated or anonymized form and is not used by us to identify you personally – it constitutes statistical data about browsing actions and patterns, which does not identify any individual.

Note: We do not knowingly collect any sensitive personal information (such as financial or health data) through our site, and we do not intentionally collect any personal information from children (see Children’s Privacy below).

How We Use Your Information

We use the information we collect for the following purposes:

Provide Updates: If you sign up for our email newsletter, we will use your email address to send you our newsletter and periodic updates about Sim Club (for example, announcements about our opening, promotions, or events). You will only receive these communications if you have provided your email and consented to receive them.

Site Analytics and Improvement: We use aggregated data from Google Analytics to analyze website traffic and user behavior on our site. This helps us understand which pages or features are most popular and how visitors navigate the site, so that we can improve our website’s content, layout, and functionality. For example, knowing how many visitors view a particular page or how they found our site (via search engine, social media, etc.) informs our efforts to make the site more useful and user-friendly.

Communication and Customer Service: If you contact us with a question or request (for instance, by emailing us at our info@simclub.com address), we will use your contact information and message to communicate with you and address your inquiry. We may keep a record of our correspondence to better serve you or future users.

Legal and Security Purposes: We may also use information to protect the rights, property, or safety of Sim Club, our users, or the public. This includes using data to detect or prevent fraud and to enforce our Terms of Use or other policies if necessary. For example, we might review log data (which includes IP addresses) to help troubleshoot security issues or investigate any suspicious activity on the site.

We do not use your personal information for any purposes other than the above. In particular, we do not sell or rent your personal information to third parties, and we do not use your information for targeted advertising or any automated profiling.

Cookies and Analytics

Our site uses cookies and similar tracking technologies only for the purposes of analytics via Google Analytics. A cookie is a small text file that is stored on your device when you visit a website. The cookies used by Google Analytics allow us to recognize repeat visitors and collect information about how our site is used. The only cookies in use on our site are first-party analytics cookies for Google Analytics. We do not use any advertising cookies or third-party tracking pixels on our pre-launch site.

How Google Analytics Works: Google Analytics uses cookies to analyze how users use our site. The information generated by these cookies about your use of the website – which may include your IP address and browsing data – is transmitted to and stored by Google on servers (which may be in the United States or other countries). Google uses this information on our behalf to evaluate use of the website, compile reports on website activity, and provide other services related to site traffic and internet usage for us. We use these reports and insights to understand aggregate user behavior and improve our website’s content and structure.

Google Analytics collects information in an anonymized form; it reports website trends without identifying individual visitors. This means we do not receive personally identifiable information through Google Analytics. Google may use the data collected from our site for its own purposes in accordance with Google’s privacy policies (for example, to improve its Analytics services or to help personalize ads in its advertising network), but we do not control those practices. You can learn more about how Google handles data collected for Analytics in the Google Analytics Privacy documentation.

Your Choices for Analytics: If you do not want Google Analytics to be used in your browser, you can install the official Google Analytics Opt-Out Browser Add-on, which prevents Analytics from running. Additionally, most web browsers allow you to refuse or delete cookies. If you disable analytics cookies, our site will still function for you, but our ability to analyze and improve our site based on your visit will be limited. By using our site without disabling cookies, you consent to our use of Google Analytics cookies as described in this policy.

Third-Party Sharing and Disclosure

Sim Club does not share your personal information with third parties, except in the limited situations described below. We do not sell your data to anyone, and we do not share your information for third-party marketing. When we do share data, it is only to support our own operations and is done under strict controls:

  • Service Providers: We may share your information with trusted third-party service providers who perform services on our behalf. This includes services such as managing our email newsletter distribution or providing website analytics tools. For example, if we use an email marketing platform to send out our newsletters, that platform will process your email address to send you the emails on our behalf. Similarly, we use Google Analytics as a third-party analytics provider, which processes site usage data for us. These service providers are given access only to the information necessary to perform their specific services, and they are contractually obligated to protect your information and to use it solely for the purposes we specify. They are not permitted to use your data for their own purposes.
  • Legal Requirements and Safety: We may disclose personal information if we have a good-faith belief that such disclosure is required by law, regulation, legal process, or governmental request (for example, in response to a court order or subpoena). We may also disclose information if needed to enforce our Terms of Use or other agreements, or to protect the rights, property, or safety of Sim Club, our customers, or others. For instance, if required by law enforcement or regulators, or to investigate and address illegal activities (such as fraud or security threats), we might share relevant data as legally necessary.
  • Business Transfers: In the event that Sim Club undergoes a business transaction such as a merger, acquisition, corporate reorganization, or sale of assets, your personal information may be transferred to a successor or affiliate as part of that transaction. If such a transfer occurs, we will ensure that your personal information remains protected by this Privacy Policy (or you will be notified and given an opportunity to opt out of the transfer, if required by law).

Outside of the scenarios above, we will not share or disclose your personal information to any third party. In particular, we do not give any third-party companies access to our user email list and we do not exchange your information for money or other valuable consideration (in other words, we do not "sell" personal information).

Data Security

We take the security of your personal information seriously. Sim Club implements reasonable security measures to protect your data from unauthorized access, loss, misuse, or alteration. These measures include technical safeguards (such as encryption and secure network protocols) and organizational safeguards (such as limiting access to personal data to only those in our team or service providers who need it for the purposes described above). While we strive to protect your information, please understand that no method of transmission over the internet or method of electronic storage is 100% secure. Therefore, we cannot guarantee absolute security of your information.

However, we do employ up-to-date security practices and monitor our systems for possible vulnerabilities and attacks. In the unlikely event of a data breach that compromises your personal information, we will notify you and the appropriate authorities as required by law, and we will take all reasonable steps to mitigate any potential harm. We also encourage you to take precautions when using the internet (such as using unique passwords and keeping your newsletter account email secure) to further protect your information.

Data Retention

We retain your personal information only for as long as necessary to fulfill the purposes for which we collected it, or to comply with applicable legal requirements.

  • Email Addresses: If you sign up for our newsletter, we will keep your email address on file as long as you remain subscribed to our mailing list. You can unsubscribe at any time (see Your Rights and Choices below), and upon doing so, we will remove your email from our active mailing list. We may keep a record of unsubscribe requests or email address removal to ensure we honor those requests in the future, as required by law.
  • Analytics Data: Data collected through Google Analytics is retained by us in aggregate form for trend analysis. Google Analytics may retain certain anonymous usage data for a set period (as controlled by our settings with Google), but we do not have access to personally identifying analytics data beyond that retention period. IP addresses used for analytics are anonymized or deleted in accordance with Google's policies and our configuration.
  • Other Communications: If you correspond with us (for example, via email), we may retain that correspondence for a period of time that is reasonably necessary to address your inquiry or maintain records for our business purposes (such as demonstrating how we handled user communications). We will not retain personal correspondence data longer than needed.

Once personal information is no longer necessary for the purposes for which it was collected, we will delete it or anonymize it in our systems so that it can no longer be associated with you. For example, if we discontinue the newsletter service, we will securely erase the email list unless retention is required for legal compliance. Please note that backup archives of data might be retained for a short duration as part of routine IT backup processes, but we have safeguards to ensure archived data is protected and deleted on schedule.

Your Rights and Choices

You have certain rights and choices regarding your personal information. We want to empower you to control your data and make informed decisions. Below, we outline the options available to you, including specific rights under California and European Union law.

  • Access and Correction: You have the right to request access to the personal information we hold about you. In practice, for most users this will simply be the email address provided for our newsletter. If you would like to know what information we have about you, you may contact us at any time (see Contact Us below), and we will provide you with a summary of the data we possess that is associated with you. If any of your personal information is inaccurate or has changed (for example, you want to update the email address you provided), you have the right to request a correction or update. We will be happy to correct any inaccuracies to keep your information current.
  • Deletion (Right to Erasure): You have the right to request that we delete the personal information we have collected from you. If you no longer want us to have your information, you can request that we remove it. For instance, you might ask us to delete your email address from our records entirely. Please note that if you have an active subscription to our newsletter and you ask us to delete your email, we will treat that as an unsubscribe request and you will stop receiving emails from us. In some cases, we may need to retain certain information for a period of time to comply with legal obligations or legitimate business purposes (for example, proof that you consented to communications, or records of transactions if any in the future). But if your information is not required for such purposes, we will honor your request and delete it.
  • Opt-Out of Communications: If at any point you decide you do not want to receive our newsletter or promotional emails, you have the right to opt out. You can do this easily by clicking the "unsubscribe" link included at the bottom of every email we send. Once you unsubscribe, we will stop sending you further marketing or newsletter emails. You can also request to opt out by contacting us at info@simclub.com with a message that you wish to unsubscribe, and we will manually remove you from the mailing list. There is no penalty or adverse effect for opting out of marketing communications – you can always re-subscribe later if you change your mind.

California Privacy Rights

If you are a California resident, you are entitled to certain rights and disclosures under state law, including the California Online Privacy Protection Act (CalOPPA) and the California Consumer Privacy Act (CCPA, as amended by the CPRA). We are committed to respecting these rights and providing you with the information and control required by California law. In summary, California residents have the right to:

  • Know What Information is Collected: You can request that we disclose the categories and specific pieces of personal information we have collected about you. In this Privacy Policy, we have already outlined the categories of information we collect (email addresses and website usage data). You may contact us for further details on your specific information.
  • Request Deletion: You can request that we delete any personal information about you that we collected from you, subject to certain exceptions (such as if we are required to keep it for legal reasons). As noted above, we will delete your data upon request in most cases, since our data collection is minimal.
  • Non-Discrimination: We will not discriminate against you for exercising any of your privacy rights. This means we will not deny you services, charge you different prices, or provide a different level of service because you have exercised your rights under privacy laws.

Because Sim Club only collects a minimal amount of information (and does not sell data), some CCPA provisions (such as the right to opt out of sale of personal information) are not applicable. We want to emphasize that we do not sell your personal information (as "sell" is defined under California law), so there is no need for you to submit a do-not-sell request. Additionally, we do not share personal information with third parties for their direct marketing purposes.

Do Not Track: California law (CalOPPA) requires us to disclose how we respond to "Do Not Track" (DNT) browser signals. DNT is a privacy preference that you can set in your web browser to indicate that you do not want to be tracked across different websites. Currently, there is no consensus in the industry on how to interpret DNT signals, and our site does not respond to browser DNT signals in any special way. In other words, we do not alter our data collection and use practices based on a DNT signal from your browser. However, please note that we only track users in the limited ways described in this policy (analytics and site functionality), and you have the ability to opt out of analytics as described above. We also do not track your browsing activities across third-party websites.

If you are a California resident and would like to exercise any of your privacy rights, you may contact us (see Contact Us below). We will take reasonable steps to verify your identity before fulfilling a rights request (for example, by confirming you have access to the email address associated with the data). Any information you provide to verify your identity will only be used for verification purposes.

European Union (GDPR) Rights

If you are located in the European Union (EU) or European Economic Area (EEA), you have additional rights under the General Data Protection Regulation (GDPR). Although Sim Club is a U.S.-based business primarily serving local customers, we aim to provide appropriate transparency and control to all users, including those in Europe. Under the GDPR, EU/EEA individuals have the following rights regarding their personal data:

  • Right of Access, Correction, and Deletion: You have the right to access the personal data we hold about you, and to receive a copy of it. You also have the right to request correction of any inaccurate personal data, or to request deletion of your data entirely. As noted, the typical data we might hold is an email address for our newsletter; you can request confirmation of whether we have your email and ask us to correct or remove it as you wish.
  • Right to Restrict or Object to Processing: You have the right to request that we restrict the processing of your personal data in certain circumstances, or to object to certain processing activities. For example, you may object to us using your data for direct marketing – in which case, we will absolutely cease using it for that purpose. (As stated, we currently only use your data for the purposes you signed up for, like sending you the newsletter or improving our site.)
  • Right to Data Portability: You have the right to obtain a copy of the personal data you provided to us in a structured, commonly used, and machine-readable format, and to have that data transmitted to another controller where technically feasible. Given the limited scope of data we collect, this right will likely apply in a straightforward way (for instance, if you wanted a copy of your subscription information, we can provide it in a simple format).
  • Right to Withdraw Consent: Where our processing of your personal data is based on your consent, you have the right to withdraw that consent at any time. For example, if you signed up for our email newsletter (consent to receive emails), you can withdraw that consent by unsubscribing from the newsletter. Withdrawing consent will not affect the lawfulness of any processing we conducted prior to your withdrawal.

Our legal bases for processing personal data under GDPR are typically: (a) Consent – for sending newsletters or marketing emails, we rely on your consent which you provide when you sign up (and you can withdraw it as noted); and (b) Legitimate Interests – for processing analytics data to improve our site, we rely on our legitimate interest in understanding usage of our website (since this processing has limited impact on individuals' privacy and is necessary for running an effective service). We do not engage in automated decision-making or profiling in any way that produces legal or similarly significant effects on individuals.

If you are an EU/EEA resident and have a question or request regarding your rights, you can contact us at any time. We may ask you to verify certain details to ensure we are dealing with the correct individual. We will respond to all legitimate requests within the timeframe required by law (typically one month, extendable if necessary).

International Data Transfers: Please note that the personal information we collect from you will be processed in the United States, where Sim Club is based. If you are accessing our site from outside the United States, be aware that your information will be transferred to and stored on servers in the U.S. (or other jurisdictions where our service providers may operate). The data protection laws in these jurisdictions may differ from those in your home country. However, we will take appropriate measures to ensure that your personal data remains protected according to the standards of this Privacy Policy and applicable law when it is transferred internationally. This may include using European Commission–approved Standard Contractual Clauses or ensuring that service providers participating in data transfers adhere to frameworks that provide an adequate level of protection. By using our site or providing us with your information, you consent to the transfer of your personal data to the United States and other jurisdictions as needed for our operations.

Children's Privacy

Our website and services are not intended for children under the age of 13. We do not knowingly collect personal information from anyone under 13 years old. If you are under 13, please do not submit any personal information to us (including your name, email, or phone number). In the event that we discover we have collected personal information from a child under 13 without verifiable parental consent, we will promptly delete that information from our servers. If you are a parent or guardian and you believe that a child under 13 may have provided personal information to us, please contact us immediately so that we can investigate and take appropriate action to remove the data.

(For residents of certain jurisdictions, such as California, different age limits may define a "child" for privacy purposes – e.g., under 16 for opt-in to data sales under CCPA – but in any case, Sim Club's policy is to avoid collecting data from minors. We encourage parents and guardians to supervise their children's online activities.)

Links to Other Websites

Our site may contain links to websites or content operated by third parties, including social media pages (for example, links to our business profiles on Instagram or Facebook). Please be aware that once you leave our site or are redirected to a third-party website, this Privacy Policy no longer applies. We do not control the privacy practices of other sites. We are not responsible for the content, security, or privacy practices of any third-party websites. If you click a link that takes you to an external website, we encourage you to read that site's own privacy policy and terms of service to understand how your information may be collected and used there. We provide third-party links solely for your convenience or information, and their inclusion does not imply that we endorse or have reviewed those external sites or their policies.

Changes to This Privacy Policy

We may update or revise this Privacy Policy from time to time to reflect changes in our practices or to ensure compliance with relevant laws. If we make any material changes, we will post the updated Privacy Policy on this page and update the "Effective Date" at the top of the policy. We encourage you to review this Privacy Policy periodically to stay informed about how we are protecting your information. If the changes are significant, we may also provide a more prominent notice (such as a banner on our website or an email notification, if appropriate). Your continued use of our site after any updates become effective will constitute acceptance of those changes.
